Intellectual Property Considerations
The Victorian Government, in the course of its ordinary business, creates, acquires, funds and uses intellectual property (IP).
IP law is conducted in an international context that is reflected in Australian domestic law. IP laws derive from various sources including international treaties, Commonwealth legislation and the common law.
The Whole of Victorian Government Intellectual Property Policy Intent and Principles (IP Policy) was endorsed by Cabinet in August 2012. It is the State’s framework for the ownership and management of its IP, as well as for the use by the State of IP belonging to other parties.
These Intellectual Property Guidelines (Guidelines) support the IP Policy and provide additional background, context and guidance.
The IP Policy and these Guidelines replace all previous policies on government IP, including the Guidelines Relating to Victorian Crown Copyright (August 1991).
